Latest information on The Dunes new home development south of Reed Hertig on HWY 101.

Over the last few months many have wondered what is going on with the new housing development just south of Reed Hertig called The Dunes. Formerly the old Bill Reed farm, this property was platted out in 2016 and as a result a modification was made to HWY 101 to add an exit lane south bound and enter lane to accommodate 87 new homes. We contacted Gail Henrikson Community Development Director Clatsop County and this was her reply. Also she attached 4 documents that show the county information on this three phase development that should clarify what is actually going in and where.

Thank you so much for your update on the STR hearings. On another note we have a BOD meeting tentatively next week and some members of our Association had some questions about the new Dunes Development and its potential impacts on the north end of Surf Pines and traffic access to HWY 101.

(Our Question) We noticed that HTA Properties LLC have begun laying out lots on the second phase. In looking at the GIS Tax Maps for the county this area is zoned RA-5. Based on the cluster rules in  Clatsop County Standards Document, S3.150-S3.161it appears possible to cluster homes but some are confused as to how over 100 lots of .25 acres comply with this zoning this was approved or are they using Taxlots 71016000020071015CB00100,  and 710160000300 as off sets for the cluster development at the North West corner adjacent to Sunset Lake?

(Gail Response) I’ve attached the phasing plans for Dune Estates (formerly Westlake Village).  Three phases are proposed, with a total of 85 1-acre lots. For cluster developments 30% of the project must remain in open space, excluding roads and property under water. Tract “E” Open Space, which is now owned by the North Coast Land Conservancy, is being used towards their open space requirement.  Tract “E” Open Space (TL 710160000302) was previously owned by HTA, but transferred to the NCLC for long-term conservatorship. Phase I is completed and Phase 2 is about to be completed.  Completed meaning the roads and infrastructure are in place, not that all the houses are built.  Phase 3 has started construction. The engineering is completed, grading permits have been issued, and waterlines, electric and cable connections ready and road grading and rocking ongoing.  That is per an email from Harry Henke, the developer of the project.  Code Compliance was out on site a couple of weeks ago and verified.  The lots that are showing up on Webmaps are in the Loch Haven Highlands subdivision, which was platted back in 1968.  The approval that was issued for Phase 2 was for 30 1-acre lots that would erase the old Loch Haven plat.

(Our Question) Some members also were led to believe the Tax-Lot 710160000200 was going to be sub platted into 1 Acre lots. Since the county GIS map shows this plat to be 57.12 acres and has not been sub-plated to date and is zoned RA-5, they are concerned that property changes will impact the lots along Silverspot LN at the west side of this taxlot across Sunset Lake. They are interested in confirming if this lot will be subdivided? If so what would the lot sizes be and if so will they be included in any hearings regarding this zone change?

(Gail Response) That is correct.  TL 710160000200, 71015CB00100 and 710160000300 are all included in Phase 3 of the development.  Phase 3 will consist of 27 1-acre lots.  No zoning changes are proposed or required.  The subdivision, including all three phases, was originally approved in 2016 and the conditions of approval were revised in December 2016 (attached). Extensions, which are permitted by code, were approved for all three phases (see attached). If I recall correctly, the phasing numbers between Phase 2 and Phase 3 may have been switched.  It’s been so long, and so many changes have happened on this project, that I might be mis-remembering.

(Our Question) Lastly, several members are very confused about the single lane access out of a community of now over 130 buildable lots. It was their understanding that HTA Properties LLC were only given approval for the phase 1 properties with the expansion of the intersection of Bing LN and 101. Now with over 100 new lots going in, how did they get approval to only have this one access in and out of this development and the subsequent impact on traffic. This is especially concerning since it is not far from the S curves just north of Reed Hertig.

(Gail Response) There is will 87 total lots as the Loch Haven plat, which currently shows on Webmaps, will be overwritten by the new plat.  The conditions of approval for Westlake Village subdivision require 2 access roads.  There was significant opposition at the time this project was approved to having any connection to Sunset Lake Road.  Therefore, a “break-away/knock-down” barrier will be required by building permits can be issued for any homes in Phase 3.

Thank you for your complete reply. Your answers make much more sense and I will probably send it out to all our members in one of our e-mail blasts. I think you have answered the questions that I had received. The only follow on question I would have is when will the GIS map be updated with these new Phases? I think that may be where a lot of the confusion comes from. T

The maps won’t change until the new plat is recorded.  Assessment and Taxation only makes those changes one time per year, when they update the tax roll, so it may not show up until January 2023.
